1. Acceptance of Terms

By downloading, accessing, or using the Go Birdie Go application (“App”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please do not use the App.

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are a resident of California and under 16, you must have parental consent before sharing any personal information.

3. Subscription and Billing

• Free Trial: New and eligible returning users are entitled to a one-week free trial. Any unused portion of the free trial period will be forfeited upon purchasing a subscription.
• Subscription: The App operates on a subscription basis, granting access to premium features. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. All subscriptions can be managed through the App Store.
• Cancellation and Refunds: Users can cancel their subscriptions at any time via the App Store. All transactions for fee-based services are non-refundable. However, we reserve the right to cancel any transaction at our sole discretion, in which case you will receive a full refund.

4. User Rights Under GDPR and CCPA

If you are a resident of the European Union or California, you have specific rights regarding your personal data:

• Access and Portability: You may request access to the personal data we hold about you and request a copy in a portable format.
• Correction and Deletion: You may request that we correct inaccurate data or delete your personal data. Certain legal or contractual obligations may prevent us from fulfilling this request.
• Data Processing Objections: You may object to the processing of your personal data for specific purposes, such as marketing.
• Do Not Sell My Personal Information: Under CCPA, California residents have the right to opt out of the sale of their personal information. Go Birdie Go does not sell user data.
• Withdrawal of Consent: If processing is based on your consent, you may withdraw this consent at any time.

5. Data Collection and Use

We collect and process the following user data:

• Eye Alignment and putting analytics for the purpose of providing personalized insights and performance tracking.
• Device and app usage data for feature improvement and bug resolution.

We process your data based on the following legal grounds:

• Consent (where required).
• Performance of a contract (e.g., providing the App’s services).
• Legitimate interest (e.g., improving our App).

6. Data Retention

We retain user data for as long as necessary to provide our services, comply with legal obligations, resolve disputes, and enforce our agreements. You may request data deletion by contacting us at support@gobirdiego.com.

7. Data Sharing and Third-Party Services

We do not sell your data to third parties. However, we may share data with trusted service providers to support the App's functionality, such as Firebase, our database platform. These providers are bound by strict confidentiality and data protection agreements.

8. User Conduct

By using the App, you agree not to:

• Engage in any unlawful or prohibited activities.
• Attempt to gain unauthorized access to the App.
• Use the App in any manner that could damage, disable, overburden, or impair our servers or networks.

9. Intellectual Property

All content, features, and functionality of the App are the exclusive property of Go Birdie Go and are protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, redistribute, or reverse-engineer any part of the App.

10. User Feedback

By submitting feedback, suggestions, or ideas to Go Birdie Go, you grant us the right to use such feedback for any purpose without any obligation to you.

11. Modifications to the Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes through the App or via email. Continued use of the App after such modifications constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles.

13. Dispute Resolution

Any disputes arising out of or relating to these Terms or the App shall be resolved through binding arbitration in Peoria, Illinois, in accordance with the rules of the American Arbitration Association. By agreeing to these Terms, you waive the right to a trial by jury or to participate in a class-action lawsuit.
